What should you do after a car accident in San Antonio?

Call 911 from the scene, get checked by a doctor the same day, and say nothing to the other driver's insurer until you have advice. Those three steps protect both your health and the value of your claim.

Most people get one detail wrong here, and it is not their fault. Texas used to ask drivers to mail in a CR-2 "blue form" crash report. However, the state stopped collecting that form on September 1, 2017 under Senate Bill 312.

Instead, the official report is now the CR-3, completed by the responding San Antonio Police Department officer. In other words, the report your claim will live or die on is written by someone who was not there when it happened, based on what people said in the first twenty minutes.

Meanwhile, you still have a reporting duty of your own. Texas Transportation Code Section 550.026 requires a driver to report a collision immediately, by the quickest means of communication, when someone is injured or killed or when a vehicle cannot be driven normally and safely.

Fortunately, calling 911 satisfies that duty. Note that this section sets no dollar threshold, despite what you may read elsewhere.

  1. Call 911 and stay put. Leaving the scene of an injury crash is a criminal offense in Texas, not a traffic ticket.
  2. Photograph everything before the cars move. Final resting positions, debris, skid marks, and the other vehicle's plate.
  3. Get evaluated the same day. Gaps in treatment are the single most common argument an adjuster uses to discount an injury.
  4. Decline the recorded statement. You are not required to give one to the other driver's insurer.
  5. Get the CR-3 number. The officer will give you a card with the crash report number on it.

How dangerous are San Antonio roads, really?

Bexar County recorded 48,522 reported crashes in 2024, roughly 133 every day. Of those, 14,101 injured at least one person and 205 were fatal.

Specifically, those figures come from the Texas Department of Transportation's 2024 "Crashes and Injuries by County" table. Within Bexar County, the City of San Antonio alone accounted for 39,805 crashes and 170 deaths. Statewide, Texas recorded 554,146 crashes and 4,150 deaths in the same year. What if the insurance company says the crash was partly your fault?

You can still recover in Texas as long as your share of responsibility is 50 percent or less. Above that line, recovery is barred entirely. This is why adjusters push fault onto you early.

The rule is Texas Civil Practice and Remedies Code Section 33.001, called proportionate responsibility. Its operative words are narrow: a claimant "may not recover damages if his percentage of responsibility is greater than 50 percent."

Below that threshold, however, your damages are reduced by your percentage rather than eliminated. For example, if a jury values your case at $100,000 and assigns you 20 percent of the responsibility, you recover $80,000. At 51 percent, by contrast, you recover nothing.

How long do I have to file a car accident claim in Texas?

Texas Civil Practice and Remedies Code Section 16.003 requires a personal injury suit to be filed no later than two years after the day the cause of action accrues, which is generally the date of the crash. For a claim involving a death, subsection (b) runs the two years from the date of death. Shorter deadlines can apply when a government vehicle or a city entity is involved, so those cases need attention much sooner than two years.

What if I was partly at fault for the crash?

You may still recover. Texas uses proportionate responsibility under Civil Practice and Remedies Code Section 33.001, which bars recovery only when your percentage of responsibility is greater than 50 percent. At 50 percent or less you can still recover, though your damages are reduced by your share. This is exactly why insurers work to assign you fault early, and why what you say in a recorded statement matters.

Do I have to file a crash report myself in San Antonio?

Generally no. Since September 1, 2017, the state no longer collects the CR-2 driver report, and the official crash report is the CR-3 completed by the responding officer.
